In December the Town of Blanchard (Blanchard) entered into a Water Services Agreement with TXLAAR, LLC. (Developer) for the planned north Caddo data center.
Here is a summary of the contract:
1. The Developer will use up to 5 million gallons per day (MGD) of water for domestic, fire protection and industrial cooling purposes with an initial demand of approximately 1.5 MGD.
2. Blanchard’s existing water system requires certain water infrastructure improvements to treat and convey up to 5 MGD (1.5 MDG initially) of town water to the data center property.
3. The Developer will, at its sole cost and expense, design and construct water infrastructure improvements to treat and convey at least 5 MGD (1.5 MGD initially) of water to the data center property.
4. Blanchard will hire inspectors for the construction of the water infrastructure improvements and will be reimbursed for these services up to the sum of $500,000.
5. Upon completion of the construction of the water infrastructure improvements, the Developer will convey to Blanchard at no cost the water infrastructure improvements, and thereafter Blanchard will be responsible for the operation, maintenance, repair, capital improvements, and upgrades, as necessary.
6. The data center “will be charged water rates based on actual water usage, measured via meter at a single or multiple locations, agreed to by the parties, consistent with Town rates for Commercial users outside of Town limits users as codified by Town Ordinance.”
A public records request is pending with the City of Shreveport to determine if a Water Services Agreement for the proposed Shreveport data center has been executed. This project has been delayed by the pending litigation requesting a judicial review of the Shreveport city council’s approval of a special use permit.
